Pennsylvania
This month, Pennsylvania State Representative Scott Conklin announced plans to regulate kratom within Pennsylvania, citing a history of overdoses and a lack of credible research supporting safe use.
Conklin intends to add kratom to Pennsylvania’s list of Schedule I substances, which would make the plant illegal to buy, sell, or possess statewide. At a press conference on April 12th, 2019, Conklin was accompanied by Centre County District Attorney Bernie Cantorna, who referenced 27 kratom-related overdose fatalities that occurred in 2017. However, according to reports, these deaths also involved other drugs.
Despite pushing for a full-on kratom ban, Conklin also stated that if kratom is useful, regulation will help pave the way for safe use. “If [kratom] is useful to individuals, then it should be studied, regulated and used as such, as opposed to being sold in a shop and place where it has no right to be,” he stated.
Louisiana
In Louisiana, kratom’s legality is also under fire. In a hearing happening today (Wednesday, May 1st, 2019), the state is scheduled to discuss proposed legislation that will ban kratom in a manner similar to Conklin’s initiative.
The bill in question, LA HB452, adds both of kratom’s primary alkaloids, mitragynine and 7-hydroxymitragynine, to the state’s list of Schedule I substances.
Previously, in 2018, legislators in Louisiana state passed LA HR177, a bill that urged the Louisiana Department of Health to study kratom as a “controlled dangerous substance.” Now, with LA HB452’s introduction, the state could push for complete kratom illegalization.
However, the American Kratom Association has assured concerned parties that they’re working to contest the ban.
